1. Acceptance of Terms

By downloading, installing, or using Matcha ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.

2. Description of Service

Matcha is a caffeine tracking application designed to help users monitor caffeine intake and optimize their sleep schedule. The App provides:

• Caffeine intake logging with 2300+ drink database
• "Safe to sleep" countdown timer
• Sleep impact predictions
• Smart cutoff alerts
• Sleep score and insights
• Apple Watch companion app
• Home screen and lock screen widgets
• Apple Health integration
• Custom drinks and favorites
• Multiple color themes

To use the App, you must:

• Have a compatible iOS device (iOS 17.0 or later)
• Agree to these Terms and our Privacy Policy

The App is rated 4+ and may be used by individuals of all ages.

5. Free and Pro Features

5.1 Free Features

Free users have access to:

• Unlimited caffeine tracking
• "Safe to sleep" countdown
• 2300+ drink database
• Small widget
• 7 days history
• Basic bedtime settings

5.2 Pro Features (Matcha Pro)

Pro subscription unlocks:

• Sleep Score and insights
• Unlimited history
• All widgets (medium, large, lock screen)
• Custom drinks
• 5 color themes
• Apple Health sync
• Weekly reports
• Smart reminders

6. Subscriptions and Payments

6.1 Subscription Options

Pro subscriptions are available in the following plans:

• Monthly: $1.99/month, billed every month
• Yearly: $14.99/year, billed annually (best value)
• Lifetime: One-time purchase, permanent access

6.2 Billing

All payments are processed through Apple's App Store. By purchasing a subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your App Store account settings

6.3 Free Trial

We may offer a 7-day free trial for new subscribers. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

6.4 Refunds

All purchases are final. Refund requests must be made through Apple. Visit reportaproblem.apple.com to request a refund.

7. User Content and Data

• Ownership: You retain ownership of all caffeine logs, custom drinks, and content you create using the App.
• Local Storage: All your data is stored locally on your device. We do not have access to your health data.
• Responsibility: You are responsible for backing up your data and ensuring its accuracy.
• Export: You can export your data using in-app features.

8. User Conduct

You agree NOT to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Transfer your account or subscription to another person
• Circumvent any access or usage restrictions
• Use the App to store or transmit malicious code
• Misrepresent App-generated data as medical information

9. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio, software, and code, are owned byWizlab and are protected by international copyright, trademark, and other intellectual property laws.

The drink database includes information about third-party brands (Starbucks, Dunkin', Costa, etc.) for informational purposes only. All brand names and trademarks are property of their respective owners.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or caffeine tracking information
• Health outcomes or sleep quality
• Reliance on App-provided calculations or predictions
• Service interruption or data loss
• Errors in caffeine calculations or sleep predictions
• Any health-related consequences

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Caffeine calculations or sleep predictions will be accurate for your individual metabolism
• The App will meet your health or sleep requirements
• Defects will be corrected

12. Indemnification

You agree to indemnify, defend, and hold harmless Wizlab, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Your use of the App
• Your health-related decisions based on App data
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the App will immediately cease
• We are not obligated to refund any fees paid
• Your locally stored data will remain on your device until you delete the App

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Thailand.
