1. Acceptance of Terms

By downloading, installing, or using PosturePix ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.

2. Description of Service

PosturePix is a posture monitoring application that uses AirPods motion sensors to track head position and alert users when their posture needs correction. The App provides:

  • Real-time posture tracking via AirPods
  • Haptic feedback alerts for poor posture
  • Session statistics and progress tracking
  • Gamification features (levels, achievements, challenges)
  • Home screen widgets (iOS)

3. Requirements

To use the App, you must:

  • Be at least 13 years of age
  • Have a compatible iOS device (iPhone)
  • Have compatible AirPods (AirPods Pro, AirPods Max, or AirPods 3rd generation)
  • Grant necessary permissions (Motion & Fitness)

4. Subscriptions and Payments

4.1 Free and Premium Features

The App offers both free features and premium features available through subscription ("PosturePix Pro"). Free users have access to basic posture tracking with certain limitations.

4.2 Subscription Options

Premium subscriptions are available in the following plans:

  • Weekly: Billed every 7 days
  • Monthly: Billed every month
  • Yearly: Billed annually
  • Lifetime: One-time purchase, permanent access

4.3 Billing

All payments are processed through Apple's App Store. By purchasing a subscription:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscription automatically renews unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your App Store account settings

4.4 Refunds

All purchases are final. Refund requests must be made through Apple. We do not have the ability to issue refunds directly. Visit reportaproblem.apple.com to request a refund from Apple.

5. Health Disclaimer

IMPORTANT HEALTH NOTICE:

PosturePix is designed as a posture awareness tool and is NOT a medical device. The App:

  • Does NOT provide medical advice, diagnosis, or treatment
  • Should NOT be used as a substitute for professional medical advice
  • Is NOT intended to diagnose, treat, cure, or prevent any disease or condition

If you experience pain, discomfort, or any health concerns, please consult a qualified healthcare professional. Always seek the advice of a physician or other qualified health provider with any questions regarding a medical condition.

6. User Conduct

You agree NOT to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Transfer your account or subscription to another person
  • Use the App while driving or operating machinery
  • Circumvent any access or usage restrictions

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio, software, and code, are owned byWizlab and are protected by international copyright, trademark, and other intellectual property laws.

The PosturePix name, logo, and all related names, logos, and slogans are trademarks of Wizlab. You may not use these marks without our prior written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Personal injury or property damage arising from your use of the App
  • Any health issues or injuries related to posture or use of the App

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or harmful components
  • The posture tracking will be 100% accurate

10. Indemnification

You agree to indemnify, defend, and hold harmless Wizlab, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • We are not obligated to refund any fees paid
  • All provisions of these Terms which should survive termination shall survive

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Thailand.
